I violated school policy of zero tolerance and if I had the money I would lawyer up. Bang_Head

I won't be wronged. I won't be insulted. I won't be laid a-hand on. I don't do these things to other people, and I require the same from them.

RE: Open carrying a rifle
you violated nothing. a school's zero tolerance policy has nothing to do with anything you did; they can ban weapons from the grounds, they can't ban someone who is wearing a holster. trust me, i'm well aware of so-called "zero tolerance" policies, and school administrators trying to use it to affect my personal life. you don't necessarily need a lawyer; try and locate an educational advocate in your area. their job is to tangle with school districts for a small fee. even if you can't find an advocate, it wouldn't hurt to talk to a lawyer, and maybe pay him a small fee to write a letter to the school, threatening legal action, even if you don't plan on following through. sometimes, all you need is a letterhead to scare the district back in line.

Waitaminute.

You're a parent. Since when does a school's policy hold power to command you? If they had a zero-tolerance policy for tank tops does that mean the moms aren't allowed to wear them when picking up the kids? If they had a zero-tolerance policy for cell phones does that mean you wouldn't be allowed to carry yours if you had to go to the office during school hours? If they had a zero-tolerance policy toward wearing hats in the building, do you have to leave that cowboy hat in your car when you go to a school function? If they have a zero-tolerance policy for shorts that are shorter than the fingertips, does that mean some of the wives are going to be given detention for dress code violation?

... I sincerely hope you do not continue to act like you are still in school and must submit to the authority of the school official. You are not, those rules do not apply to you.

exactly. if you let them get away with this now, soon, they'll try and affect their policies in your own home; the school district in my area made a lame attempt at that, saying that they wouldn't send a homebound instructor unless all the firearms were out of the home, and i wasn absent while they were there. they lost, of course, but the fact that they even tried to pull that shit is scary enough. don't think the school in your area won't try it with you.

But the cops showing up and arresting me for distressed trespass and putting me in jail and since I'm a single dad my kids would go to CYS. So the choice is my kids or my gun?

What is the definition of distressed trespass? Google doesn't have a single hit for the phrase, and nothing apparently relevant for the words next to each other.

And, I just gotta say again...
Under what authority does whomever have the power to legally forbid you from the public school grounds for violating something that is NOT A LAW.

Again, an empty holster is NOT violating the law, and nobody gave principal puckershorts the legal power to hand out restraining orders to whomever happens to be wearing something he doesn't like!

You aren't wearing a gun! What happens if you're wearing a t-shirt with a picture of an AK or AR15 on it? Is that going to get you put in jail by this NON judge? Hell no!

Principal fearful has no power over what you can legally wear. The school grounds are NOT his own personal kingdom. He wears no crown, and his edicts do not have the force of the police force behind them.

Edit: Fer chrissakes, call the cops yourself and ask them if they've been having a joke on this principal, feeding him weird bullshit that makes him think he's got the power of a judge and can order the cops to commit wrongful arrest and make them liable for his personal power trip. Ask them if they have been having a good laugh at this gullible goof, to please bring it to an end before he does something that will really cause a ruckus.

So a non-judge is asserting non-authority over a non-law upon a non-subject for the non-violation of an actual law, and has managed to restrict a person from picking up their kid from public tax-funded property...

Oh god that makes my head hurt.

Can you get any of this in writing? You need this bullying in writing.

Does the letter cite a law or statute that gives this minor egomaniac the power to call down the law on someone expressing their first amendment right of free speech supporting some other amendment?

Seriously, what happens if some PARENT shows up in a shirt with a pot leaf on it, can the principal have that PARENT arrested for violating the school's no-tolerance policy on drugs?

This situation really just makes my head spin. Please share just what power this principal really has.

Heck...that's not too far southwest of me.

So, you aren't allowed on the property at all? Or just with the holster? What if there is an issue (like an accident or illness) with your kid at school? How are you supposed to get there?

You may try to find a lawyer who only gets a fee if you win your case. You can also try talking to a judge about the issue, but I'm not sure where that will get you.

RE: Open carrying a rifle
Without a prohibited item, wearing only legally worn articles of clothing or accessories, this becomes a free speech issue.

Quote:http://www.uscourts.gov/outreach/resourc...tcases.htm

Tinker v. Des Moines (1969)
Students do not leave their rights at the schoolhouse door.
To protest the Vietnam War, Mary Beth Tinker and her brother wore black armbands to school. Fearing a disruption, the administration prohibited wearing such armbands. The Tinkers were removed from school when they failed to comply, but the Supreme Court ruled that their actions were protected by the First Amendment.

This sounds like a bit of censorship, a bit of the right to protest, and because it's a school it brings in student issues. Which brings this list of cases:
http://www.aclu.org/search?show=10&type=...&logic=any

And a quick click gave me this case: http://www.aclu.org/blog/free-speech/col...t-f-civics that had school officials trampling free speech rights because there was "a distraction".

CALL THE ACLU.
